Data protection for

Universities manage academic records, research involving personal data, student work placements and international transfers in collaborative projects. Art. 34.1.f) of the LOPDGDD establishes the express obligation to appoint a DPO for all universities, both public and private.

The student's academic record is a register of personal data with its own rules on access, rectification and retention, which coexist with GDPR rights.

Research involving personal data

The GDPR provides a specific regime for scientific research that permits exceptions to the consent requirement, subject to pseudonymisation and ethics committee approval.

Frequently asked questions about data protection in universities

Are private universities required to appoint a DPO?

Yes. Art. 34.1.f) of the LOPDGDD establishes the express obligation to appoint a DPO for both public and private universities. This is not a matter of discretionary analysis: the law names them explicitly. Although this is the general rule for the sector, the final requirement will depend on the scale, volume and exact nature of each entity's processing activities. Each case requires individual analysis.

Can a student request access to their academic record?

Yes. The academic record contains the student's personal data and they have the right to access it. The university must respond within one month. The right of access to the academic record regulated by university legislation coexists with the right of access under the GDPR.

Is there a special regime under the GDPR for research involving personal data?

Yes. The GDPR provides for an exception for the processing of data for scientific research purposes (art. 9.2.j and art. 89). Universities may process special categories of data in research projects without the data subject's consent, provided appropriate safeguards, pseudonymisation and the relevant ethics committees are in place.

How should data be handled in students' work placements?

When students access third-party data in the context of external placements (companies, hospitals, public bodies), the host entity is the controller of that data. The university and the host entity must contractually regulate the student's access to data and their duty of confidentiality.

Can a final degree or master's dissertation include data on identifiable individuals?

Only if the appropriate legal basis exists (data subject consent or the research exception) and if the data are properly protected. Publishing the dissertation in open repositories may constitute a data transfer requiring anonymisation or the explicit consent of the individuals concerned.

Do international transfers in research projects require special safeguards?

Yes. Collaboration with universities and institutions outside the EEA in research projects involving the exchange of personal data requires adequate safeguards: standard contractual clauses, countries with an adequate level of protection or, in the case of research, the derogation under art. 49.1.d GDPR where necessary for reasons of public interest.
