Social Media Privacy Policy

1. User Information

Who is responsible for processing your personal data?

CERTIFICACIÓN Y GESTIÓN NORMATIVA S.L.U, hereinafter the CONTROLLER, informs the USER that it has created a profile on the social networks Facebook, Instagram, Twitter, LinkedIn and Youtube, that it is the controller of the personal data of the user processed on those social networks and informs them that this data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD), and therefore provides the following information about the processing:

Why do we process your personal data?

Purpose of the processing: to maintain a relationship between the USER and the CONTROLLER which may include the following operations:

  • Processing requests and enquiries submitted to the controller
  • Informing about activities and events organised by the controller
  • Informing about products or services offered by the controller.
  • Interacting through official profiles.

On what grounds may we process your personal data?

Legal basis for the processing: Article 6(1)(a) GDPR, the data subject has given consent to the processing of their personal data for one or more specific purposes. The USER has a profile on the same social network and has decided to join the CONTROLLER's social network, thereby showing interest in the information published therein. Therefore, at the time of requesting to follow our official profiles, they provide their consent to the processing of those personal data published on their profile.

The USER may access the social network's own privacy policies at any time, as well as configure their profile to ensure their privacy.

The CONTROLLER has access to and processes the USER's public information, in particular their contact name. This data is only used within the social network itself and will only be incorporated into a CONTROLLER file when necessary to process the USER's request.

For how long will we retain your personal data?

Data retention criteria: data will be retained for as long as the USER does not revoke the consent given as indicated in this privacy policy.

To whom do we disclose your personal data?

Data communication: information provided by the USER through the CONTROLLER's social networks, including personal data, may be published, always depending on the services used by the USER, and may therefore be available to other third-party users of the social networks. From each social network profile, the USER can configure what information they wish to make public in each case, view the permissions that have been granted, delete or deactivate them, as with any third-party application they no longer wish to use.

No disclosure of personal data to third parties outside the social network is envisaged, except where strictly necessary for the development and execution of the purposes of the processing, to our communications service providers, with whom the CONTROLLER has entered into the confidentiality and data processing agreements required by current privacy regulations.

What are your rights?

Rights available to the USER: these may only be satisfied in relation to information that is under the CONTROLLER's control.

  • Right to withdraw consent at any time.
  • Right of access, rectification, portability and erasure of your data, and to restrict or object to its processing.
  • Right to lodge a complaint with the supervisory authority (www.aepd.es) if you consider that the processing does not comply with current regulations.

2. Use of the Profile

The CONTROLLER will carry out the following actions:

  • Access to the public information of the profile.
  • Publication on the USER's profile of all information already published on the CONTROLLER's social network.
  • Sending personal and individual messages through the social network's channels.
  • Page status updates that will be published on the USER's profile.

The USER can always control their connections, delete content they are no longer interested in and restrict with whom they share their connections; to do so they must access their privacy settings.

3. Publications

The USER, once they are a follower or have joined the CONTROLLER's social network, may publish comments, links, images, photographs or any other type of multimedia content supported by it. The USER, in all cases, must be the owner of the published content, hold copyright and intellectual property rights or have the consent of the affected third parties.

Any publication on the social network, whether texts, graphics, photographs, videos, etc., that violates or is likely to violate morality, ethics, good taste or propriety, and/or that infringes, violates or breaches intellectual or industrial property rights, the right to one's own image or the Law, is expressly prohibited.

In such cases, the CONTROLLER reserves the right to immediately remove the content, without prior notice, and may request the permanent blocking of the USER.

The CONTROLLER will not be responsible for content freely published by a USER.

The USER must bear in mind that their publications will be seen by other users, so they themselves are the main person responsible for their privacy.

Images that may be published on the social network will not be stored in any file by the CONTROLLER, but will remain on the social network.

4. Data of Minors or Persons with Special Needs

Access and registration through the CONTROLLER's social networks is prohibited for persons under 14 years of age. If the USER has special needs, the intervention of the holder of parental authority or guardianship, or their legal representative, will be required by means of a valid document certifying the representation.

The CONTROLLER will be expressly exempt from any liability that may arise from the use of social networks by minors or persons with special needs. The CONTROLLER's social networks do not knowingly collect any personal information from minors. Therefore, if the USER is a minor, they must not register, use the CONTROLLER's social networks or provide any personal information.
